TERMS OF USE
These Terms of Use ("Terms") govern your use of the websites and mobile applications provided by Hatod Express Inc. (referred to as "Hatod Express", or "we" or "us") (collectively the "Platforms"). The services we provide or make available include (a) the Platforms, and (b) the services provided by the Platforms and/or by Hatod Express and made available through them (collectively, "Services"). Any new features added to the Services are subject to these Terms. These Terms govern your use of Services provided by Hatod Express.
Please read these Terms carefully. By accessing and using the Platforms, you confirm that you have read, understood and accepted the Terms including any additional terms and conditions and any policies referenced herein, available on the Platforms, including specifically the consent to the processing of your personal data in accordance with the terms set out in the Privacy Policy. If you do not agree to or fall within the Terms, please do not access or use the Platforms, or the Services.
WHO MAY USE THE PLATFORMS
The Platforms may be used by (i) natural persons who have reached eighteen (18) years of age and (ii) corporate legal entities, e.g. companies. Where applicable, these Terms shall be subject to country-specific provisions as set out herein.
Users below the age of eighteen (18) must obtain consent from parent(s) or legal guardian(s), who by accepting these Terms shall agree to take responsibility for your actions and any charges associated with your use of the Platforms and/or purchase of Goods. If you do not have consent from your parent(s) or legal guardian(s), you must stop using/accessing the Platforms immediately.
REGISTRATION
In order to use the Services, you will need to register for an account on the Platforms ("Account"). To create an Account, you must provide accurate, current and complete information during the registration process and keep your Account information up-to-date at all times.
You are solely responsible for maintaining the confidentiality of your Account login details and for all activities that occur under your Account. You agree to immediately notify us of any unauthorized use or suspected unauthorized use of your Account or any other breach of security.
USE OF THE PLATFORMS
You agree to use the Platforms only for lawful purposes and in a manner that does not infringe the rights of others or restrict or inhibit anyone else's use and enjoyment of the Platforms. Prohibited behavior includes harassing or causing distress to any person, transmitting obscene or offensive content, or disrupting the normal flow of dialogue within the Platforms.
INTELLECTUAL PROPERTY
All content included on the Platforms, such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the Platforms, is the property of Hatod Express or its suppliers and protected by copyright and other laws that protect intellectual property and proprietary rights.
LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Hatod Express shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the Platforms or Services.
GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the Republic of the Philippines.
